He's actually got some persuasive arguments on this issue and I think it'll be easy for the Court to throw him a bone and give him the W which is probably the right thing to do. That, in turn, will hopefully make it easier for them to punt on immunity. That's crystal clear, the Court of Appeals provided an airtight opinion, and it shouldn't require SCOTUS' review.
