I'll defend it. Virginia created a purge program that not only plainly violated federal law, but also wrongly removed citizens from the voter rolls because of outdated or incorrect information. The fraud is all on your side on this one.

Why shouldn’t the court take evidence on that point?

Va allows for provisional ballots as a fail-safe measure.

If they’re actually non-citizens they can’t vote and should be removed from voter rolls. If they’re actually ID’d as non-citizens on the rolls they still won’t be able to vote even if on the rolls. There has to be more to this story. It won’t have any impact in the end.

They weren't ID'd as non-citizens on the rolls, but rather at the BMV. Say someone gets a license as a non-citizen, then gets naturalized and registers to vote. This person can vote legally, but Virginia would purge them, anyway.
 
It appears, as always, that the devil is in the details, and different stories are coming from the two sides.

Make no mistake, non-citizens should not be allowed to vote.

Fact: There is a law that eligible voter lists are frozen 90 days before an election. After that is called a quiet period. Why? A last minute decision to remove people by mistake would deny them an opportunity to appeal, and voting is a constitutional right for US citizens.

The judge decided that, following the law, this couldn't be done in the quiet period. Supporting the decision was evidence that indeed mistakes were made here. At least 3 people deleted from the voter rolls file with the court documents confirming PROOF OF THEIR US CITIZENSHIP.
