Their posts are misleading. Here's the reality. In order to find Trump guilty of felony falsification of business documents, the jury must unanimously find that Trump falsified the documents in order to commit or conceal a separate crime. The jurors don't have to agree as to what the separate crime (i.e. the predicate crime) was. The three possible predicate crimes are a tax law violation and a violation of state or federal election law.
My understanding is that this issue was briefed, argued and ruled on by Judge Merchan several days ago. The jury's ability to disagree as to the predicate crime is consistent with NY law.
