I that guy on Fox lied, why does that not surprise you. He said that the president has the absolute authority to declassify "anything he wants" it is a bald faced lie. He cannot declassify who our spies are, he cannot declassify nuclear secrets.


Further, as that link points out, Biden just has to say "everything Trump declassified is now classified again" and like magic, it is all classified once again.

And yes, it is reported that some of what was found could lead to human spies being burned and some is reported to be nuclear.


But we should not worry, there is no chance China, Russia, or Iran would try to embed agents at Mar-A-Lago. That wouldn't be cricket.
There's no chance of Iran, Russia or China getting agents into Mar-A-Lago unless they can come coming up with the 250k membership fee-so no worries. I suppose some of the cleaning staff could be illegal immigrants trying to make a little extra scratch though.

One is much more dangerous. There is no way Trump sat before hundreds of documents and carefully considered if it was safe to declassify them. NO WAY. Especially if some were nuclear and some revealed human intel, neither he legally could declassify. If he did ponder over each document, how did he debate taking them, and then declassify them when he could not do so?

Start at the base level. No document that the executive branch classifies begins its life as classified. It’s created, reviewed, and given a classification status. In fact, the classification program was created by executive order to organize sensitive information. So any number of government documents from the beginning existed and had to be designated as classified or not. There is literally no difference whether a record is classified immediately after its creation or later.

Furthermore, the focus on classification status is a red herring. From reading the PCA, it had two trains of thought. 1) that he was in possession of a lot of classified docs that included significant amounts of national defense information. 2) regardless of technical classified status and even assuming that the former president HAD declassified everything he could, sensitive NDI can’t just be disseminated or held onto in an non-secure facility.

The bell cliche is about the prejudice caused when something improper is presented to a jury. At least that’s always been my understanding but we should probably double check that with IUCrazy with his litigation expertise. And the bell cliche doesn’t really apply either because let’s assume no one saw the “declassified” documents. Then you could “unring” the bell because no one would have heard it in the first place, or more philosophically, did the bell even ring if no one heard it in the first place.

Let me use the case of Sandy Berger. He took classified data home. At that point, we have to act like Russia/China/Iran has the data because they might. But that did not mean we email them a copy to make sure. We recover it and keep it classified.

So as far as we know, every US document is declassified.

But even excepting that, if those documents still contain info we would prefer adversaries not have, there is no reason to email the info in the documents to them. Reclassify but acknowledge the horse MIGHT be out of the barn (and it might not).

That must have been later in the day as during the day they weren't talking about the unredacted search warrant. Fox's job is to always defend Trump no matter what the circumstances.

The magic word is 'nuclear'. Just mention the word and you freak out. You have no idea if 'nuclear' is in the affidavit.

However, it is nice that leftists are now so worried about classifying government documents after they didn't give 2 shits that Hillary had them on her private server and actually deleted them and destroyed their blackberries. What a conversion!

You don't. And he got off with probation and has his access to classified documents restored.

Got it. The government never classifies anything because it shields certain actors from embarrassment, investigation, or even criticism. Same goes for redactions from search warrant applications. Classifications are always on the up-and-up.

I suppose. But it’s still a bad analogy because, like I said, if it hasn’t been seen by anyone otherwise unauthorized, then the cat can go back in the bag.

Still, the classification issue is a red herring because it’s not necessarily about classified documents. It’s about NDI within documents, whether classified or not. This is particularly obvious because the Espionage Act predates the Truman EO starting the classification process by like 40 years. So whether something is classified is immaterial to whether it is potentially damaging NDI.

If you cared about classified information that HRC recklessly mishandled and stored on her unauthorized unsecured email server and don’t care about the classified information Trump has recklessly mishandled and stored in an unauthorized and unsecured physical location, you’re a hypocrite.

Which lawyers here are national security experts? The Constitution makes no mention of security classification. My guess is being a naval captain is roughly the equal to an Army Colonel, Aloha has the most real experience. Anyone here top that?
