Milley should be heavily criticized for his role in the Afghanistan withdrawal. While he's not in the operational chain of command, he's a top military advisor to the President. He advised the President that he didn't think the Afghanistan withdrawal would probably go well, and it certainly didn't. I think seeing the Taliban would do what it did was foreseeable and should have been foreseen. I don't know what article would apply to that. I can't think of one. What happens to officers that give bad advice is they're fired from their jobs and leave service.

Yes. I read it with the knowledge that the Chairman of our Joint Chiefs call their counterparts in China (Russia, India, whatever), and the other way around, on a fairly regular basis. They do this to make sure we don't develop dangerous situations. It's really not a huge deal and it's most definitely not treasonous in any way. We had a strange situation when it wasn't clear that the outgoing President was going to allow the peaceful transfer of power. None of this is meant to be argumentative, Stoll. I'm just letting you know what I know and my opinion on it. I still think Milley gave a bad assessment of the Afghanistan withdraw plan and that's a much bigger deal to me and he deserves a ton of criticism of that (it's an appropriate congressional investigation and accountability), but still not a criminal thing which would merit a criminal investigation.
