Politico: Roe to be overturned per draft opinion

I'm trying to think, what evil liberal posters goes straight to level 3?

Plaxico and TMP?

Hoops to me is more level 2 but tends to stay there.

We all dip into level 2 depending on escalation.

The rest tend to keep it at level 1.

I like the grading system. Now we just need to incorporate into an overall posting score to go along with the reaction score plus to give instant feedback.

Let's tackle our cooler decorum from a data perspective. Give time outs based on data (of course the levels need to be better outlined and easier to measure).

I know that examples of "Florida Man" can certainly sound made-up, but they are (sadly) quite real, and the vast majority of Florida Man specimens indeed seem to also be "Florida MAGA Man".

For places that are red, that likely means bye bye abortion. For blue states, they will probably be able to kill their kids to their little heart's content.
I expect we’ll not hear you complaining about welfare then since the best way to limit that is to reduce birth rates for poorer segment of the population that utilizes welfare?

and of course I’d push for contraception and education first (are you supportive of that), but let’s be honest, abortion is a necessary backup for that segment of society given lower education levels and general behavior.

The three prominent theories are:

1. A lowly clerk. The likelihood of this is very low. Clerks tend to be law students doing grunt work very early in their careers. This would be a career ender.

2. A liberal justice. Motive is to get it out, cause a ruckass and put public pressure on the court to think twice about it.

3. A conservative justice. Motive is the document names all of the justices who are in agreement. It's speculated that Robert's might be a soft vote and is looking for another soft vote to flip back. By putting it out now with names attached, it will force those that flipped to have to explain why they flipped to the public which they don't want to do. By leaking it early it more solidifies the vote.

Add on, plus it maybe takes away some conflict of interest attention from the Jan 6th committee with a certain wife (that was me making a joke).

So yeah, tarred and feathered.

Are you upset that it appears one or more of the trump elected judges appeared to have lied to congress about their intent with Roe vs Wade? That used to be considered serious.

The one side that is feigning upset is the hypocritical one. End of story.

The only real point of concern is whether the leak affects the judges’ decision. It won’t. Gorsuch and Kavanaugh lied to get on the bench, they’ll lie to stay on it.

First, one is a general characterization while the other is quite specific. (Also, "racist Nazi" is kind of redundant, don't you think?)

I think most would agree that Nazis are evil, but obviously not all evil people are Nazis.

Next, is there a factual basis for the allegation? If not, then it's a reprehensible smear. If so, then I'd argue it's not an insult but a declaration of fact. For example, in the highly unlikely event that a poster were to come to this august forum and spew anti-Semitic tropes and other hate speech, argue that Hitler was a victim, express admiration for Hitler and Nazi causes, suggest that Jews were somehow responsible for World War II and the Holocaust while simultaneously arguing that the Holocaust wasn't really as bad as it's been portrayed, and make other unfounded claims that read like they came straignt from a WS website, then I think it's fair to characterize that person as a Nazi or at least a Nazi sympathizer.

Come on! No one on this board would post such BS. (TIC)

It was bad but it did absolutely nothing.

McConnell's actions in stealing a supreme court seat had far more impact on the integrity of our government than a leak that accomplished nothing.

So if you get a dent in your car, do you go around yelling "My car is destroyed. It's worthless. The dinger ruined my car. The travesty"

SCOTUS has been a political football since (at least) Bork.

I flip between Fox, CNN and MSNBC during commercials on whatever program I may be watching just to see who is whining about what.
All three have expressed outrage about the leak.

I am a channel flipper too, and while they all report it and express outrage, they certainly have differing thoughts of where the leak ranks in terms of the entire story.

Fox: all about the leak.
1) The leak is the worst thing ever;
2) what are those crazy protesters doing;
3) there is no slippery slope

CNN & MSNBC: the leak is a sidelight.
1) the angry reaction of women;
2) the slippery slope and what's next for gay marriage, contraception, etc;
3) oh yeah, somebody leaked it

The opinion's a problem for the GOP in November. They'd much rather talk about the leak.

I assume (with no inside information) that it was a liberal staff member, because the unusual, irritating Republican tactics over two years that led to this apparent result have led so many people to cry out for transparency in how the Supreme Court operates. Republicans are not strong enough to be truly Machiavellian -- remember how "imposing" a figure Milquetoast Roberts was during the impeachment hearings? But Republicans generally are more than happy to sit in the background and let their hypocrite leaders be McConnellian and then act like tough guys claiming they were in charge all along.

And, keep in mind draft opinions are not state secrets and the Supreme Court does not have its own Code of Ethics, so it's still unclear what "rule" was violated or what the consequences will be for the leak. In fact, I believe there is a rule in the federal court system stating that all released appellate opinions are subject to a 30-day time period in which revisions and further changes can be made, so even the first legitimate publication of a past Supreme Court ruling was not necessarily the final version either.

However, since you brought it up, I think the leading candidate among the justices themselves for Scenario 3 is Long Dong Silver (i.e. Mr. Someone-Put-A-Public-Hair-On-My-Soda-Can), the one justice known to do and say whatever he wants throughout his entire term and apparently also known to discuss court business with his political activist wife. Roberts loves the SC too much to leak this, and Alioto doesn't seem so goofy as to leak his own draft. If any of the Trump justices have a little integrity, it's Gorsuch -- so, I just don't think he did it. Kavanaugh and Barrett are conservatives but act like little children yet too uncertain of their immense power to leak an opinion. (He got confirmed by saying, "I like beer", not by saying "I like leaking." She got confirmed by saying basically nothing.)

I'd love it if it turned out to be one of the actual justices who leaked it instead of just some underling who foolishly was given access to drafts on the Supreme Court's computer system. A poor underling who leaked it would surely be vilified by Republicans wishing to deflect from the content of the draft itself.

Yes, I believe it should be abolished in most instances in every single state. That is my goal. Remove Roe and that fight goes to every single state. With Roe we could not discuss any type of restrictions. I am the far right on this position. About 30% of the country thinks like me. That leaves 70% of you to have hashed out some type of deal where abortion would have been able to exist in some form or another up until a certain timeframe. Whenever there were any restrictions introduced, there was always an immediate "no restrictions at anytime" reaction from the other side.

I believe abortion is basically homicide. There is not a whole lot of wiggle room in my position. There should be a shit ton of wiggle room at almost every position to the left of me. CoH, Twenty02, Aloha, McMurtry, etc. are all Republicans who all are ok with abortion in some form and up to some point but any attempt to compromise was always rejected. "If we get an inch they will want the whole mile..." Yeah, I would want 5270 of the 5280 feet of the mile, all those people to the left of me would have accepted quite a bit less. The U.S. public has a majority opinion that abortions should be reserved to the first trimester. There are a whole bunch of states (and GOP reps) who would have accepted that compromise over the last 49 years. I wouldn't, my pressure would have been to keep moving, but I am also pragmatic enough to know that at a nationwide level, it takes time to change opinions. So I would have been good with the Overton Window shift at least in the short term.

I believe someone posted that 26 states are probably going to move to restrict/ban abortion if Roe and Casey are overturned. Now you got people talking about "compromise". However, now my 30% is in the position of power. The Aloha's, CoH's, Twenty02, and McMurtry's of the world don't care enough about the topic to be on the pro-choice side and that 30% is almost exclusively GOP. So I win in over half the country. And on this particular topic I am really not in a "compromise" mood. So the GOP won't be in one either. The absolutist position on the left was the worst one to have because they had everything. They could have negotiated pieces of it away and still kept the majority of what they wanted. Most abortions occur in the first trimester...couldn't live with that though. I am here to tell you that if it were the other way around, I am one of those who would say that rape, incest, and life of the mother are totally on the table. Those incidents are so rare that I would be saving a ton of lives and my "reasonableness" on the subject would probably be enough to keep the aforementioned "we don't really care" people in the "we don't really care" column. That would have sidelined the left. They would have pushed for more, but for Democrats it would be a mostly settled issue. Those leftists are not going to vote for a Republican but there is a portion of that 30% on my side who would be somewhat open to some of the Democrat economic arguments.

Finally, this all went back to Goat's notion that Pro-Life people were to blame for all of this. I don't think that is the case. 49 years of never being thrown a bone. 49 years of chipping away. 49 years of waiting. That constitutes 49 years that the pro-choice position could have moderated at all, but instead it became ever more absolutist. And possibly now after 49 years, they are going to find themselves in the opposite position in half the country. And frankly, personally, I am spiking the ball. The other side had won, all they had to do was take a knee. Instead they tried to run up the score, fumbled, and we are back to a tie game.

So, if you believe a fetus has the rights you describe paramount to the rights of its parents, what rights do you agree a 4- 5- 6-year-old actually born person has to legally demand to be vaccinated against childhood diseases paramount to the rights of its parents? You can't have it both ways.

Reading all these posts it sounds a lot, an awful lot, like the conservative/Republican recognition of parental rights (or not) is inconsistently applied and totally depends on politically motivated issues (i.e. can we get Candidate X elected if we scream XYZ about abortion).

But, you have a good weekend and drink many beers like Brett Kavanagh.

Sope suggested a while back more regional governance. I like that. The Midwest is kind of goofy with Illinois but the south is fairly like-minded, the NE, calif, wash, Oregon, then western states. Tx, az, nm.
This absolutely is not a brilliant or original idea.

It was proposed 40+ years ago as a hypothetical.


It remains a total distraction from real solutions.
