I'm not conversant in Title XI so not the one to ask re the substance.
Re procedure, I'd have to see more facts on the class issues. It's possible. Re timing, at first blush, I'd say the case had the best chance of success if filed before the swim meet in question. If the judge denied the PI based on no irreparable harm (which would be a weird ruling, but possible), you wouldn't have to explain yourself on why you filed so late. I don't know who the lawyers are, but if they are being paid for by a conservative advocacy group, this will go as far as they can push it.

Don't have any idea on the legal merits, but the complaint reads like it was filed primarily for the purpose of getting in the news.
