Trump Takes the Fifth

I think Michael Cohen nailed exactly why Trump took the 5th. And it's interesting to hear him point out the role the info he provided has played in this case going forward and what the 5th does and does not mean in a civil case. After all he is a lawyer, and Trump hired him for his legal expertise...

Donald Trump being tried in civil court is an oxymoron.

Speaking of which, has anyone ever seen a more moronic ox than Trufus?
 
I'm reading that in a civil case like this taking the 5th CAN be used against you.
The fifth is in the 4 th amendment to the constitution. But it specifically applies to criminal cases. While it can b used as agent orange did yesterday in a civil case, it will most definitely b used against him with the jury. Prosecutors can say that the inference is that he is guilty by using this defense. They will also use his previous statements regarding guilty people pleading the fifth. The question now becomes what will b the financial penalties as he will no doubt b found guilty in this case.

Just what all of us need. More people telling us we screwed up while strewing it up. I had a simple mistake on my tax filling. They put a lien on my car. No freaking warning. You know how long it took to fix that? I’ve been to the field office and it’s still not taken care of. The paperwork is fixed but the amount of crap and red tape to get that fixed is insane because it involves multiple agency’s that tend to make tons of mistakes. If you think for a minute this move is a good thing you have major issues.

No idea who the "Holy Spirit" is, but Cohen's cooperation and turning state's evidence is the major reason the NY case is proceeding and why Trump was even in court in New York to "take the 5th"...

Just like the WSJ has reported the reason the FBI even knew there was still classified documents at MAL and conducted the raid was that someone within Trump's inner circle ratted him out. Otherwise the FBI wouldn't even know that when Trump returned the first 15 boxes of documents he illegally removed from the WH, that there was a treasure trove still unlawfully being stored at MAL...That makes a total of 27 boxes confiscated that contained classified documents that he never should have removed from the WH...

Nah couldn't possibly be. If you havent done anything wrong or knowingly done anything wrong you have nothing to fear. That is what I keep hearing. How could it possibly be that the IRS made a mistake?

As long as it’s not hurting them they don’t care. Now I have a stamped title. Can’t even junk the car.

Horrible, at least with law enforcement the burden of proof is on them but not with IRS . If anything they needed reform not 86,000 jackboot thugs on power trips. I just imagine the scenario of who would even want to be an agent, likely people that got picked on a lot in school and are going to make up for it and lets give them guns too.

Let’s just call it what it is. They want the revenue they think they are owed. They will flag many innocent people too.

How many times does it have to be said that there is no evidence that even ONE new IRS agent has been hired, let alone 86,000? It's a fake talking point. A LOT more funds have been allocated to the IRS. Maybe they will modernize.

3 mil and change for taxpayer services
45 mil and change for enforcement
25 mil and change for operations/support
4 mil and change business systems modernization

45 mil for enforcement is obviously for agents. if the avg agent makes 50k that'll afford a shit ton of agents

10 years of funding

*billions not millions

You know damn well they will be expected to create revenue one way or the other. Think getting caught in a cops speeding ticket quota is bad that will be nothing. They will drive some people to suicide that have never even known the Clinton's. This is one of the absolute worst things to ever get smuggled into a bill and all of the idiots going on about if you havent done anything wrong you have nothing to fear have no clue and no I have never been audited.

Even if you have done nothing wrong and don't owe the government fighting it can break many small business/self employed even if you win in court. To me if the IRS loses the case the govt should be forced to pay all of the plaintiffs bills . Hell they should make the agent pay part of it and maybe that will be some checks and balances of sorts?

Funny how liberals are all for defund the police but are all gung ho on sending accountants out with guns to harass and intimidate people. Unlike law enforcement with the IRS you are guilty and must prove your innocence. Going to guess the number of small business owners is overwhelmingly GOP . Dems are content working for the government .
I would think the same amount of gun carrying IRS agents equal the same amount of gun carrying IRS agents during the last administration.

Ever notice that the guys who complain the most about taxes r the ones who can afford to pay. They take advantage of all the great things this country has to offer then complain that they have to help pay for those advantages. No one likes paying taxes myself included but I pay what I owe. Just wish those who can afford to would at least pay their fair share.

What’s “fair”. Take indiana for instance. One of the Highest fuel tax rates and still have crappy roads. Kentucky fuel price is 80 cents cheaper. That’s a huge chunk.

I don't think Trump understands that he doesn't avoid giving evidence by taking the fifth -- that's because the fact that he took the fifth itself becomes evidence.

Sort of. Not dispositive evidence tho. It's probably smart. he hopes to avoid criminal prosecution and prevents providing information which is likely fatal to his civil defense. so plaintiff gets an inference but that inference can't be the sole basis for liability. the plaintiff still has prove its case with other evidence

I’m asking what’s fair. Answer the question. Ky hasn’t always had a dem in charge as Indiana hasn’t always had a Republican in charge.

Believe me they aren’t great and I’m very critical of them. Still not an answer to the question. (Without bias)What is “fair”.

We can all argue how taxes should be set up. I think fair is getting rid of every single loophole and have tiers where people pay the same percentage in taxes within each tiers (tiers based on level of income).

So I would say fair is everyone paying based on whatever factors are decided upon and not finding loopholes to get out of it or falsely reporting to get out of it.

Comparing one state to another is likely apples to oranges since 1 tax may be higher, another lower and possibly difference in services and other stuff between different states.

Fair is paying period. Had personal experience with a family member who kept two sets of books and banked offshore to hide taxable income. Was a multimillionaire and could afford to pay but did everything possible to avoid taxes. I’d approve of hiring a hundred thousand IRS agents if it meant they’d catch the tax cheats. We all know that won’t happen. Personally I’d audit anyone with income over $500k. And I’d make sure anyone caught cheating did real jail time in a real prison. Not in a club fed. Have to incentivize the cheats enough that they comply and pay their fair share.

Need to check those numbers again. Indiana is 14th at 32 cents a gallon and Kentucky is 31st at 24.6 cents a gallon. And I’m talking about federal income taxes. That’s where the real problem is. Personally I love Florida because we built r new home here two years ago and we pay no state income taxes whatsoever. Saves us thousands each year. However, it’s more expensive with respect to many other things here. Still wouldn’t even contemplate moving back to Indiana. Sun shines every day here.

I didn't make it about anything. He pointed out the difference in taxes in the states, and I pointed out who was responsible for making/enforcing laws in both states.

And why do you mention Chicago? There are plenty of GOP cities with a higher per capita murder rate than Chicago. Bakersfield CA which has more homicides than either LA or SF for one...

Wouldn't the other evidence just include a bunch of possibly inconsistent documents from Trump's tax filings and banks that don't agree with each other (as Cohen talked about)? Also, maybe some testimony from insiders like Weisselberg and Cohen?


A lot of tax and bank documents already include a sworn statement anyway. If they can show Trump had knowledge of stuff, but signed those anyway, well maybe ... who knows. We'll see.

Well it’s now up to agent orange to object to the release of the DOJ’s application. All agent orange media has been demanding the release of the pertinent documentation. B careful what u wish for. Betting he’ll come up with a lame excuse for why he doesn’t want the information in the public square. How could u possibly explain away the keeping of classified materials when the government has repeatedly asked for them back and even issued a subpoena this past summer. My guess is he was going to try to monetize them. Always been his MO. Garland called his bluff again. Funny how agent orange signed into law new penalties for mishandling of classified information. Bumped up the penalty to 5 years. Chickens could b coming home to roost.

What I prefer to see is the application for search warrant, which might have more informative information about what the govt was looking for and why.

We already know they were looking for classified documents. There is no explanation he can possibly use to justify the taking of classified information unless u have a nefarious intention. Can’t wait to hear agent orange’s mouthpieces defense of why they now shouldn’t b released. Probably going to keep insisting they were planted even though his attorney was present during the search.

What I want to see at this point are:

1. The application for the June grand jury subpoena;
2. The June grand jury subpoena itself;
3. The government's receipt given to Trump to record the documents taken from Mar-a-Lago under the June grand jury subpoena;
4. The application for the August search warrant;
5. The August search warrant itself; and
6. The government's receipt given to Trump to record the documents taken from Mar-a-Lago under the August search warrant

Trump and his lawyers surely have some of these documents already, so he could release them if he wanted. (Or, maybe he just wants to keep whining.)

I live in indiana and work in Kentucky. 80 cents. Difference. That’s what I said. Didn’t say it was all tax. It’s funny when you are so biased you didn’t read it. It’s 60 cents difference this afternoon but it was hovering in the 80 cent range like it was yesterday afternoon. Get on gas buddy and look.
