The text of Trump's EO on gender identity makes all of us legally female

Some of the language (emphasis mine):
“Female” means a person belonging, at conception, to the sex that produces the large reproductive cell.
“Male” means a person belonging, at conception, to the sex that produces the small reproductive cell.

The focus is not on sex as assigned at birth but sex at time of conception, an obvious tilt demanded by anti-abortion views.

The problem with this wordsmithing is that it ignores basic science. At fertilization, and for many weeks after, every embryo is female. "At conception" we are are female, and so Trump just defined EVERYONE as female. The sex-specific changes kick in around the sixth week of embryological development when a gene called SRY starts to be expressed. From that point onwards, most people with an XY genotype will follow a male developmental process.

So are all Americans women now? Is Trump the first female president?

This criticism is factually accurate. No embryo is phenotypically male at time of conception. Maybe they could have said that the embryo was genetically predisposed to, after maturation, produce eggs or sperm. But they didn't, due to fundamental scientific illiteracy.

Should have been "at birth," but this is meaningless. No one is running to the hospital after a night of hot sex to have the brand new embryo tested, if baby making sex was successful, and won't know the female is pregnant until later. When they do the tests for sex of the baby it's long after it's developed into a male or female. It's de facto meaning will be "at birth."
 
Buy the gas, drive to a farm, and steal some eggs. Or better yet, steal some chickens. Just make sure they’re not roosters.
I siphoned some gas from my neighbors truck so I’m good for a few days. My other neighbor has a chicken coop and is a Texan so that should give me a right to his eggs. I was here first.

Words matter, though. They're why lawyers exist. It's just funny that they thought they were being so cute and sciencey with their definitions, and then fell flat on the science in such an obvious way. They seem to be having serious problems defining male vs. female...

Not all embryos have the SRY gene. Only the ones that will be born male.

Of course I did, and of course I fully understand that the SY gene is located only on the Y chromosome and that becomes activated only well after fertilization.

But the location of the gene (or even its EXISTENCE) is irrelevant in how they wrote the definition of male vs. female embryos. They focused on only the characteristic of producing eggs vs. producing sperm, at the time of conception. A physical characteristic, a PHENTOTYPE, not a genetic characteristic, a GENOTYPE.

Bio 101.

When an egg is fertilized, you get what is known as a zygote. About 5-6 days after implantation in the uterine wall, it develops into what is called a blastocyst. The blastocyst then develops an amniotic sac, a huge evolutionary step in moving away from the amphibian way of life, and becomes an embryo 10-12 days after fertilization.

At or around eight weeks, more or less, the embryo is classified as a fetus.

The initial fetal stage, and all prior stages, are phenotypically female. For example, by the very early fetal stage, nipples develop. That’s why even male mammals have nipples, like a faucet on the wall with no plumbing developing later on.

A phenotype, by the way, is a categorization based on physical attributes. What you SEE. Different from genotype.

At or around 12 weeks, more or less, two main phenotypes of fetuses begin to diverge. Fetuses with a Y chromosome express a gene that drives the production of testosterone, which results in the development of male genitalia along what is called the genital ridge, that line down the middle of the male scrotum. What about the fetus with no Y chromosome but instead two X chromosomes? Then that ridge turns into a labia. Other hormones are released after gene activation to give a multitude of female phenotypic attributes.

Sure, it gets tricky in rare cases such as XXY and XYY individuals. And when hormonal genes for some genetic reason don't turn on. Or don't turn off. Or the timing is off. A whole constellation of things can go awry.

But...set all that aside for now.

Bottom line, Dear Leader has decreed is that everyone on the planet is to be classified based on the sexual phenotype existing at the time of conception. There exists, by this decree, one sex, female, the one characterized by the uniform phenotype that is only later diverted by Y chromosome-induced testosterone production.

That's what the EO says and what it means.

Silly? Sure.

It could have said the sex is based on the presence (or not) of a Y chromosome. The genotype. Or on phenotype, after about 12-16 weeks. But the first seems beyond their grasp, intellectually, and the second didn't fit with their worldview, that a person is a person, even when only an undifferentiated clump of cells.

Elon maintains that Hitler wasn’t a fascist but rather a communist (apparently in Elon’s world Hitler was a bad guy or even worse a loser).
