Well, it's already illegal to manufacture a firearm and sell it without a license. Also as has been pointed out here, it was illegal for the guy to buy the firearm.
So, I guess I'm not sure what new law would have prevented this atrocity.

Private sales loopholes. Everyone who buys a gun should have to pass a background check. It’s why he went private after he was denied.
