So first off let's look at what actual left wing sources were saying about Kavanaugh's attempted "assassination"...

Now 77 assuming you know what hypocrisy means... Can you explain why people on your side are arguing that gun legislation in the wake of Uvalde (where 22 were killed horribly) is "political", but the same people (in this case Moscow Mitch) turn around and DEMAND legislation after a single wacko is arrested after THREATENING to kill a single person...

Had it been Indiana, it would imo be sufficient probable cause for Intimidation. He's communicating a "threat" as that word is defined in Indiana law with specific prohibited intent. Which is a serious felony if the threat is communicated to a judicial officer.

I grant you that a low % of statements of intimidating nature are actually charged.........especially statements relating to underlying political topics. But remember what Joe told us.....the 1st amendment is not absolute..........

I am in no way a lawyer, but I believe I saw a video from a lawyer a year ago talking about the Chicago 8 trial. IIRC, in order to prove incitement to riot / violence, the statement had to be promoting said violent action imminently. The video was a crossways look at the Chicago 8 compared to Trumps Jan 6 speech.

If I am remembering that correctly, then I doubt this meets the legal requirement since Schumers statement was made back in 2020.

He shouldn't have said it and he even realized that, walking it back the following day. That doesn't make it right, but would probably take the heat off in terms of an intimidation charge. Did DJT ever walk back any of his hateful rhetoric?

Those are entirely different charges. The Indiana Intimidation statute requires communicating a threat with the intent that the other person will engage in conduct against their will or be placed in fear of retaliation for a prior lawful act. I'd say the intent element is covered.

What about "threat"? One definition of threat is "expose the person threatened to hatred, contempt, disgrace, or ridicule" Another is "unlawfully injure the person threatened or another person, or damage property."

Now here's what he said: "I...tell YOU, Gorsuch. I...tell YOU, Kavanaugh, you RELEASED THE WHIRLWIND and YOU WILL PAY THE PRICE. You WON"T KNOW what HIT you IF you GO FORWARD WITH THESE AWFUL DECISIONS".

As I mentioned earlier, intimidation of a JUDGE raises the level of the charge significantly.

Now the question is, what does "release the whirlwind" mean? It certainly appears to mean making past decisions that Chuckie did not like. What does "pay the price" mean? Well, in this context, imo, it means, at a minimum, nasty ass protesters continuous screaming profanities outside your house and verbally threatening you and your family. And getting the Maxine Watters treatment of similar harassment at public functions. That is...releasing the mob. I'm sure this is what Chuckie had in mind, but it could also mean an attempted assassination or a molotov cocktail or two thrown at his house. Which would be collateral damage. You have to break eggs to make an omelette.

So I think there is probable cause, if the relevant jurisdiction wished to pursue it. There is wide latitude for political speech, so it won't happen, but that would have to be raised as a defense. As Joe told us, the 1st amendment is not absolute.

I'll say one other thing........if a private person had said exactly the same thing that Chuckie said exactly the same way, he could expect at least a visit from the FBI. It was an incredibly reckless thing to say.
