Bomba Exonerated by Law Firm

I have no idea what happened. I will say I practice in areas where these investigations are done and sometimes the firms aren’t truly independant and are really hired to provide cover for a potentially liable entity. Again, I have no idea about what happened here or the law firm’s independence.

The lawsuit will go forward. IU hired this firm to dig into it and report back to IU. I assume IU will now not negotiate any kind of settlement with these money grabbing ex players and their ambulance chasing attorneys.
Does this give Bomba or his family any grounds to counter-sue for defamation or damage to reputation?

I am not an attorney but I would think this gives them some ammunition.

Attorneys on here would have to tell us. I think those kind of suits are tuff. Maybe if you could get trial in Monroe county and even better yet a county like Greene or Daviess.

So what law firm does IU go to next time to pay a big fat retainer? This is relatively meaningless.

It does. That’s why they do it. But an investigation cannot be unbiased when the entity paying the bill benefits from a certain outcome.

Not sure Bomba has any damages, even if he could make a defamation case.

He's an 80-something year old retiree. Maybe he's lost out on consulting income, but I doubt it.

Tim Garl might have damages though. His contract was not renewed. If it was because of false statements, he'd have a case.

That would be a pretty expensive F you. Only way to hire a lawyer on a case with no damages is to hire one by the hour. $300 an hour (or more) adds up pretty quick.

Of course, it's not your money he'd be spending, so I'm sure you're all for it.
 
They’ve made the facts pretty clear. Dr Bomba did rectal exams. For the 5000th time that was standard practice for a doctor his age.

Sorry. I didn’t know you had read the Depo transcripts and discovery responses. I assumed you were going off of news reports and stuff.

If there are no facts in dispute, and the resolution of any in favor of the plaintiff by the fact finder (judge or jury) would not lead to liability of defendant, the judge would grant a judgment dismissing the case. In other words, if the facts are clear in favor of the doctor, the judge will dismiss the case and no trial will occur.

In other words, even if everything plaintiffs say is true, the doctor would still no be liable….case dismissed. This seems to be what you’re saying is the case. Although this would have been dismissed on a motion to dismiss for failure to state a claim.

He's saying, in human, that you don't know what you're talking about.

By the way, there is no profession where the person's competency is judged by their age. The year when they performed? Sure. How old they were when they did it? No.

In human: Bomba's age doesn't matter.
 
It's always a mistake to look at the past in the context of today. Bomba followed the standard of care at the time and as he was educated.

If this is so black and white, the case will go away quickly. Not sure when it was filed, must have been fairly recently if your assessment of the facts is correct.
 
It seems clear he performed the exams. It was part of a complete physical for a male as he had learned it. It was probably mildly unpleasant for most of them. Some may have enjoyed it, who knows.

What is their claim of harm? Did any of them achieve any less in life because they got a rectal exam at age 18?

Some ambulance chasing Attorney will have them ready with a harrowing story of the lifetime of harm it caused.

I wonder if I can sue the bastard dentist from my childhood? The pain he caused is still causing me issues going to a dentist.
