FYI SCOTUS Update

-Regarding Biden's radical pick for SCOTUS, it all comes down to Graham. He is critical.

-Under the power-sharing agreement Republicans have with Democrats (they are evenly split 50-50), if a nominee is hung-up in committee, it essentially is tabled (the VP cannot vote to advance nominees out of committee). I talked about this a month ago, scroll way up.

-Most of the Republicans on the Judiciary Committee (Cruz, Hawley, etc) have indicated they will vote to block the nominee.

-McConnell would love to hold the seat open.

-Meanwhile, Sinema and Manchin have said they do not want a radical nominee if it makes it to the floor. But, they may be forced to vote for her.

-Odds favor Biden, as of now.

-Regardless, it won't change the balance of power on SCOTUS. We sill control it.

"If media reports are accurate, and Judge Jackson has been chosen as the Supreme Court nominee to replace Justice Breyer, it means the radical Left has won President Biden over yet again. The attacks by the Left on Judge Childs from South Carolina apparently worked."

So, Graham is a no vote. That deadlocks the commitee, unless Dems can flip one of the other Rs. Remember, they are EVENLY divided on the Judiciary Commitee. 😂

Note: I still think Biden gets her through, but this is gonna be rough for them.

I don't support affirmative action by race. Possibly by some measure of income/wealth. I'm just saying that if anyone should be appointed by race it should absolutely be an Asian, especially in light of the horrific abuse and attacks the community has faced post-covid.

You apparently never pay attention to SCOTUS and how justices often are not what their appointers presumed them to be.
 
This board we are tolerant liberals but we hate trump and we hate trump voters. But we are tolerant lol. I feel that 70% of this board are either teachers or college professors. The hardest left and militant liberal voting block there is and ones to whom liberalism is their life.

Well when someone whose political instincts are as poor as yours believes it will be rough, that usually signals clear sailing... Collins, Murkowski and Graham all voted to confirm her to the Appeals Court in the past year. Exactly what are they going to point to as far as her decisions to explain a reversal of that opinion in less than a year?

Her ruling that Presidents aren't kings in the McGahn case didn't keep any of them from voting for her. Collins and Murkowski already voted to Impeach Trump over Jan 6. Collins isn't up for re-election in 2022, but a NO vote would hurt her with moderates she will need in 2026. Murkowski will likely have to run as a write in again, and she'll need Dem votes and anti-Trump Pubs to keep her seat.

Re read Lindsey's statement. Lindsey is pandering since Childs is from his home state, but he was referring to supposed attacks by the Left on Childs, not necessarily saying the woman he voted to confirm in 2021 was suddenly "too "radical. He's used Clyburn's preference for Childs as cover, but Clyburn is not going to turn against Jackson/Biden just because he preferred his home state candidate. So if Lindsey votes against her (and Clyburn) it will hurt him with SC Blacks. Probably depends on whether that or the fear of a Trump challenge in the Primaries scares him more, but he's already voted once to confirm her so reversing will strike reasonable folks as "sketchy"...

Biden only had 1 choice so he couldn't cover every option that hasn't been on SC. His successor could have.

You honestly think Biden is going to apoint somebody who lets the law guide them. This is replacing a big liberal Breyer she will be every bit as liberal and you better believe she will be a social justice warrior. And of course if the republicans try and fight her nomination they will simply be called racists. Its the oldest playbook the dems have.
I honestly think every Prez appoints people he thinks will lean his way, but that the ACTUAL JOB of day to day court crap - and the lifetime appointment that removes the need to be beholden to anyone - tends to scrub off some of the politics and usually, not always, produces a JUDGE instead of a politician. You still get some of the philosophy you saw - Scalia stayed an originalist, Brennan and Marshall stayed liberal - and sometimes you get surprised. But more often, over time, a SCOTUS justice moves toward the center. JMO.

And thank God for stare decisis, usually.

How about Trump, "It will be a woman, a very talented, very brilliant woman. I haven’t chosen yet, but we have numerous women on the list." That was September 19, 2020 and he knew he was going to choose a woman though he didn't know which of "numerous" women he was going to select.

A lot of factors go into choosing, it shouldn't be shocking to anyone that politics is one of those factors. Here is the good news. No one is going to be the only person in America capable of being a Supreme Court Justice. Be they White, Black, male, female, Asian, or whatever, there are going to be qualified candidates.

I have no idea if Brown Jackson will be a great or even good jurist. No one does. As long as she isn't a criminal of some sort, I don't really care. The Constitution doesn't require she be American, or of any age, or a lawyer. So the qualification bar is amazingly low (we should look into that).

You can count on a reversal of that last bullet point.

Harvard/Harvard Law - I'm glad the SC is looking more like America now.

I thought Sotomayer was qualified and posted in support of her appointment on this forum even though I knew I would mostly disagree with her. She has turned out to be an unqualified gasbag. Even RBG told her to have her clerks ghostwrite her opinions.

The moral of the story is that the chairs a nominee sits in prior to taking the job is not evidence of qualifications.

There has never been an Asian on the supreme court. We have had black supreme court justices. Why should a black female come before a single Asian? Especially in the light of the recent horrific discrimination against Asians.

Yup. I do think serving as a District Judge for those years helps mitigate some of that, for lack of a better word

I like seeing she did time as a public defender, and also as a trial judge. Not all academia or clerking for judges.
 
The difference between Jackson and Barrett, Barrett will side with libs and conservatives! Jackson will only vote one way!

Barrett was in a white-shoe firm for three years early in her career. In all likelihood she was stuck in the firm's library doing research and writing briefs.

Just to be clear, I'm agreeing with you about today's nominee. The fact that she's been in the trenches will give her a broader perspective.

It really did not matter who senile joe picked it ins't a net gain it is a wash. Replacing one far left wing justice for another far left wing justice. It does not move the needle in the least except it excited the those who see everything by race which Joe is obsessed over.
