The FBI can’t confiscate their cell phones without a search warrant. I’d love to see the application for that warrant. Does the FBI think they are on the trail of terrorist? They crashed a ship into a bridge and killed 6 people. There is an active criminal investigation. If you killed 6 people driving a truck wouldn't you anticipate a full investigation by authorities?
I would imagine truck drivers in such cases routinely have phones seized to see if they were texting.
In addition, in this case it is believed mechanical problems started well before Baltimore. Phones easily can have information on that. Maybe video of other power outages, texts, etc
Of course. You still need a warrant. I’d like to see the statement of probable cause and if the authorities think terrorism. If so this could have significant implications
And it’s 100% certain that all the crew are foreigners. They aren’t letting that ship sail back wherever and starting the investigation from there.
