Looks like the Supreme Court has another case headed their way...

There is little doubt that nationwide injunctions have been TOO easy. However, the solution would be to establish conditions that must be met. Making it virtually impossible comes with its own set of issues.
Something to think about. I believe there is a carve out for class action lawsuits in this decision. So if a bunch of anchor babies are able to form a class action lawsuit they could get a nationwide injunction.

In that scenario, even if the lawsuit is successful, makes its way up to SCOTUS who affirms birthright citizenship. We now have a list of children of illegal immigrants. That could be given straight to Homan to go to work deporting the parents. Maybe a lot of them would want to take their kids with them. Pretty cool.

Aren't class actions for civil suits? What damages would they seek?

In fairness to aloha that is not a spot you want to be in. Dbm with sourced info before the networks even hear rumors. And DANC. Wow. It’s worth remembering how he even got here. He was just a poster on the football board who occasionally would correct the record when posters over there made political posts that were off. Then a certain jerk over there who was jealous of his dominance made the mistake of thinking DANC wouldn’t do the same thing on this board and dared him to come over. Well. As we all know he started collecting scalps on day one.

He did not declassify them when President and former Presidents can’t. They stopped floating that easily disproven defense. Guess you didn’t get the memo. So ignorant. So hopeless. When did I say he declassified them? I merely pointed out your double standard for Trump vs every other President. You expect documentation for him, but let Biden slide when it comes to autopen authorization - saying his verbal OK is enough.

The two issues are 100 percent unrelated. There is one standard for every President on each separate issue. There is no double standard at all. You aren’t actually stupid like other posters here, but this is a very stupid argument by you. You should stop while you’re behind because it’s impossible for you to ever catch up.

So technically, KBJ doesn't call the text legalese: she's referring to the issue Justice Barrett identifies as the main one, and that issue is an originalist one. Her dissent also doesn't focus on a textual analysis because she joins Sotomayor's dissent, which already did that.

KBJ's opinion is about as hyperbolic as it gets. The most hysterical on the left will cite and rely it upon on it, including, no doubt, some people here.

I always find it fascinating when there's so much to legitimately criticize about something, how the MAGA crowd still feels the need to attack a straw man anyway.
