I would think so. Suppose someone believed cremation was morally wrong and would block their pathway to heaven, cremating their remains would be a violation IMHO.

Assuming you are talking within the context of American constitutional law, the answer is no. There may be some instances in canon law or even common law where the dead have some limited rights, but that's really just speculation. As Marvin pointed out, it's certainly possible to violate the rights of the dead on a moral level, if not a legal one.
