He should do it with an autopen
He literally doesn't have the authority to do this. The DOE is organized by an act of Congress. This is officially a constitutional crisis.
Here comes another court injunction and it's a no brainer. Even Trump appointed judges would rule against this.
I've been for eliminating the DOE for decades, but it can't be done this way.
