It depends on the element they were hung up on. The lesser charge has a different wrongful conduct threshold. They are instructed to consider the more serious charge first.It doesn't make sense. I didn't follow the case, so I won't comment on the verdict. But the victim was homeless with 40 some arrests. It seems everyone involved knew there were mental health issues. Something needs to be done on that front. Involuntary commitment pretty much requires one to be judged an immediate danger to themselves or someone else. Maybe that standard needs slightly lowered. I don't want it too easy, but a person with mental issues that continually violate societal norms often needs to be treated. Assuming treatment exists.

A lot of people can be helped significantly with medication, but they have to stay on them. That's where much of the problems arise.Yes.
And, not to go all Tom Cruise on this, but I have my doubts about the capacity of the medical/psychological to adequately treat this sort of thing. Let me put it this way: if it's possible for treatment to curb this sort of behavior, then we're clearly failing to get it where it's needed.
