Makes me wonder A) why they felt they needed a top speed of 75; and B) who the idiot was who certified it to be able to be driven on State Roads...

That's a replica, toy, train... It never should have been able to have been driven more than 5 mph more than the top speed it would be asked to go in a parade...

If it needs to travel they should roll it on a trailer and ship it where it needs to go...

No one blows a tire these days... To let a tire reach that condition is outrageous...

Obviously I don’t know much about the situation but is it common to drive that thing on a state highway? Seems to me it’s an accident waiting to happen.Prayers to the family of the person who died.
Yea, just looking at that thing, it shouldn’t be going very fast — no way it stops or turns well and it’s not safe in any sort of collision. I’m sure as a weird one-off vehicle parts are stressed in odd ways that are hard to detect, thus the potential tire/wheel failure. Sad.

1. I tried to find the spot of the crash on a map and determine how far this was from campus. Not sure about mileage but it looks like this is somewhere Northwest of town.

2 . This happened on Thursday Afternoon. What type of event would be going on on a weekday requiring this vehicle to be at an event or traveling from an event in that time frame.

3. I know I have seen the train at special events (festivals, parades, etc.) over the Summer. I assumed that the vehicle was hauled on a flatbed to and from location, and not driven directly on a highway>

Wouldn’t be too surprising if this was a joyride. I’m just guessing.
 
Depends on a lot of things, but I imagine it’ll be over fairly quickly for either the $300k, $700k, or policy limit, as the case may be, cap.

Only way it gets really messy is if it’s really a manufacturing issue and the victim is either married or had minor children.

Yep. I guarantee you the victim's family has already been contacted by a plethora of ambulance chasers. They smell blood in the water.

Ha, I guess this club takes care of all their silly trains.

Per the website: "The Reamer Club drives the Boilermaker Special VII to every away football game, no matter how far, as it can go up to 75 MPH!" So that settles that.

I’m clear on all of that.

My point was that, for example, if victim was unmarried and had only adult children (or surviving parents), it’s capped at $300k. So no matter how many defendants you’ve got it’s one cap. If no kids, parents or spouse, then there is no “loss of love and affection damages” and it’s last medical, funeral and burial expenses only.

If it ends up being a government defendant only, then $700k tort claim cap.

Damages are only unlimited if minor kids or surviving spouse. Thats the situation where it can get messy trying to ID all possible responsible parties. Even then, you’d only get major pushback I’d imagine on the overserving claim (if that ends up being the case) and any kind of mechanical defect. Everyone else would likely pay limits without too much pushback.

It weighs roughly the same as a medium duty pickup truck. This was a horrible accident that could have happened to any medium-sized vehicle.

Even Purdue Administration is smart enough to recognize the liability of providing that type of access.

I’m not saying it’s stolen, just that people with access to it took it out for fun.

Kind of, yeah.

It’s the “adult wrongful death” cap in Indiana. Just depends on status. And if it’s a single cap, doesn’t matter how many defendants. Similarly, the “tort claim act” cap of $700k vs government defendants applies collectively too, so it’s 700k whether it comes from one government entity or 5.

I think he still works at least part-time. He's often at Mother Bear's West across from their office in a suit.
I looked Ken up on mycase.in.gov, and his 2 most recent appearances are from 2017 and 2021. Ken is a glorified mascot at this point: I hope none of their clients think he will actually be representing them.

I’ve seen it, or likely one of it’s predecessors on 65 two different times while going to Bloomington morning of Bucket games.

It is clearly licensed to do so by the state. No way Purdue allows it out there if it isn’t. Now maybe it shouldn’t be and that is some due diligence that the victim’s attorney should be doing. This is why the state BMV is on the list of those being sued

It's a street legal vehicle build on a semi frame that drives on interstate. Why can't it drive on roads? Its not unsafe.

No different than any other vehicle blowing a tire. Did the run over something, bad tire with a weak spot. Either way, sad situation.

The club that operates the train has a super rigorous training schedule that involves getting like 50 hours of drive time “training” similar to drivers Ed. Probably that.

How do you know they didn't do either? You seem to have a lot of opinions with zero facts or ideas on what happened or what they do.

I bet it is. Like most fleet areas keys are actually pretty easy to get. The key boards are easily defeated. Purdue has a very large and pretty accessible motor pool. About double the size and fleet of IUs. Of course I’m not saying this happened but they aren’t as secure as one might think.

Blame it on the Gimlet Club's drunkenness, I guess. What a strange bunch of oddballs.

So sad to read about an innocent person's death. They supposedly drive that thing to every away game too.
