SCt orders admin to facilitate return of wrongly deported Maryland man

"This has become a political hot potato for me right now. Please return the guy so we can adjudicate his case, likely return him to you, and continue to build on the relationship we have established."

He would have been heading back on a plane within an hour.
It’s all so stupid. Our politicians are just totally worthless. He’s in jail in El Salvador. Super. Bring in a laptop and sign in to free zoom and give him his hearing. The accused here appear by camera from jail every single day

The only difference with that is you would need some way of making sure no one at his end is coercing him. I am not willing to bet El Salvador has the guarantees we have. So take him to the US Embassy could work.

You would have to do something like that where he is in some sort of US custody on the chance he wins his case and is allowed to return.
 
The thing is, none of this is an undue burden on the US. But 90% of Trump's schtick is, "never compromise, apologize, back away." So we can't do it even though it would be painfully easy.

It would all go away if he'd just comply with the ruling. Give him due process and nothing to complain about.

That the lower court order be obeyed. He can be brought back and tried to have the ban to El Salvador lifted, or sent to a different third world hellhole.

What would we do if we mistakenly sent a US citizen to get them back? Do exactly that. No more, no less.

Isn’t the Salvadoran danger upon which the remain in US order is based an objective test? Garcia doesn’t have any evidence to submit anyway—he wouldn’t know. Maybe we could hold a hearing where he appears virtually. That’s becoming more common.

isn’t that what defines democracy? Fortunately, the FF inserted some safe guards. We eliminated one safeguard with the 17th amendment. There is substantial support for also eliminating the electoral college safeguard.

The democrats disregarded the laws our culture and politics produced regarding illegal immigration. Now politics has produced Trump who is trying to fix that mistake and people accuse Trump of creating a constitutional crisis and ignoring laws to get at the devil. 70-80% of Americans agree with trump. The democrats deliberately acted counter to that and we now have a mess.

1) we order other countries around all the time. 2) we signed a deal with them where we pay them to take these people, you mean we were not smart enough to include an oops clause? That would be pretty stupid. 3) if nothing else, stop paying them for him (at the barest minimum). 4) we haven't even politely asked, let alone demand

He is a Salvadoran citizen in custody of Salvadoran authorities. There is an existing deportation order issued with due process The question now is whether Salvador is a danger for him. What fo you think of a virtual hearing?

As I keep saying, when we the people become too divided over our politics (as in a culture war) our democracy is in jeopardy of becoming dysfunctional.

I'm sure he could secure the release of one person who hasn't even been convicted of a crime in El Salvador. Of course, if you can't get him out, isn't that a reason for Garcia to fear going back to El Salvador? They threw him in prison without committing a crime there. Why?

I’ve suggested repeal of the 17th Amendment frequently as a means to lessen the impact of big money in politics and to perhaps make the senate less dysfunctional.

Lincoln issued pardons and gave amnesty to avoid bullshit divisions like we see now. Trump didn’t.

Nah. Arrogance would be calling Canada the 51st state, calling the prime minister a governor and then punishing Canada for not obeying. It might also be infinitely more arrogant when you tell the Netherlands that Greenland "will be ours one way or the next".

The DOJ lawyers who admitted-- truthfully-- in court that the rendition was a mistake were fired.

CoH, don't know about the Colorado state legislature, but back home in Indiana money, as in big donors, does have influence.

This includes PAC money from both in state and outside the state who donate to local pols and run political ads. Heck, even those running for local school boards are now getting funded from PACs.

Latest phenomenon are rich candidates spending millions of their own money to run for mayor or governor.
