SCt orders admin to facilitate return of wrongly deported Maryland man

Let's see, the trial judge and the full circuit said it was wrong to send him, the Supremes said 9-0 it was wrong, in their filing the DoJ said it was a "mistake", and you are arguing it was perfectly correct? How thin is that branch?
And the Supreme Court ruled the administration needs to facilitate his return. Fine. Bondi said they would fly him back to the US if El Salvadore released him. What more do you want?

There's the law and then there's what's right. Was it legal the way he entered the US? No, it wasn't. Were millions like him allowed in with no effort to stop them? Yes. Is it physically possible to give everyone who is here illegally a trial to deport them in any kind of reasonable time? No.

Tell you what - you spend half the time complaining about the millions of illegals allowed in by NOT enforcing US law as you do deporting one illegal, and then we can talk about who's following the law.

In fact, it specifically says you can only apply AFTER entering the US.

You may only file this application if you are physically present in the United States, and you are not a U.S. citizen.​
So you can wait to be arrested and then apply? I'm sure there's no incentive for fraud there.

I realize you feel badly for the guy. I do, too. Fact is, he broke the law by coming here and only applied for asylum after he got caught.

Please be specific and tell how many judges will be needed and how many cases they'll need to hear each day.

You really think they wouldn't return Kilmar Abrego Garcia if Trump actually wanted it and put pressure on them to do so? He looked pretty chummy with their leader. Shouldn't be as hard as prisoner exchanges with enemy countries.

Kilmar Abrego Garcia committed no crime in either country and saw no day in court prior to being deported. You want to defend that? Seriously?

He entered the country illegally in 2011 but an immigration judge in 2019 (while Trump was president) withheld his deportation to El Salvador. Now the entire (majority conservative) Supreme Court has ordered he be brought back to the US. Doesn't seem like judges agree with Trump here.

But you want to claim you're not blindly loyal to Trump.. sure.
 

Brings back memories of "Papillon" starring Steve McQueen and Dustin Hoffman. With those two in it, it could've and should've been a much better film than it was.

The author of the novel had promoted it as an autobiographical account of his escape from the prison on Devil's Island in French Guiana. Turned out he made most of it up. He had escaped a French prison, but it was a mainland prison. He'd never even been to Devil's Island. And most of the anecdotes in it had come from other prisoners.

I have linked two different government websites on how to apply for asylum. Both say you have to be in the US. It may be a bad law, but I believe it is the law. If you want more, this specifies that an alien must apply within 1 year of coming into the US.


(B) Time limit​

Subject to subparagraph (D), paragraph (1) shall not apply to an alien unless the alien demonstrates by clear and convincing evidence that the application has been filed within 1 year after the date of the alien's arrival in the United States.​

I don't care if he gets sent back so long as it is according to what the law is. This reminds me of Colorado trying to kick Trump off the ballot, I said I would agree with whatever ruling the court made. Same for Biden's student loan plan; go back and see if I complained about either one. If the court rules Trump has the power, the court rules it. But that isn't what happened.

If we need to change the law, change it. During COVID, Trump instituted Title 42, which did change it. But Biden later changed it back, and the public emergency was removed anyway, probably making it invalid. It does not appear that Congress has changed it.

We knew it would be like this. Biden totally f'd up and now it's up to Trump to fix it.

They supported illegal immigration but now insist on following the letter of the law.

The funny part is, Trump is willing to fly the guy back if El Salvador releases him. Trump is following the orders of the Supreme Court and it's still not enough for them.

I am favor of following the rules. My wife says I am Sheldon Cooper about my fanaticism, like on jumping lines. If Trump had done this and the courts said nothing, it would not have bothered me. Much like Biden, if the courts told him he had to enforce the border more than he had to do that. To my knowledge no one said he was in violation. So there is grey. I don't know law, so I have to trust what the courts say the law is. I have seen lawyers on here, very bad things happen to legal minds. It is powerful black magic that destroys.

Trump admin clearly didn’t do their due diligence on this one but cry me a river for this guy.

His claims of threats to his safety in El Salvador are likely just BS as the “asylum claims” that came across the border under Biden.

Bukele has no ****s to give. He’s not coming back. Which is sad because it doesn’t seem this guys actions warrant being in that prison the rest of his life. But I also don’t care.
