Should a warrant be required before an American citizen could be placed under surveillance?

The secret FISA warrants are aimed at the foreign actor, but if the foreign actor is communicating with US citizens, that's just too bad for them.

The FBI has not made a public case to show that the law does anything more than allow them to snoop on Americans under the guise “surveilling foreign intelligence targets”.

They should rewrite FISA to comply with the Constitution. They had that chance.

Congress gave itself a nice little carve out in the FISA 702 reauthorization bill permitting warrantless spying on American citizens.

The bill REQUIRES the FBI to notify and seek consent from Congress before violating the privacy of congressmen.

Anyone surprised by this?

I didn't see one RINO, Real Republican, Federalist Society member or John Birch janitor complain about the FISA courts for decades....All of a sudden you woke up? Republicans have no one to blame for the FISA Courts then themselves.... Of the current FISA Court Judges, everyone was appointed by John Roberts. Of the prior to Roberts, the judges were appointed by Burger and Renquist. I would add, that Roberts has been very active in appointing judges. Be careful what you wish for....you just might get it. And you have

Over 99% of surveillance requests have been approved by the various judges in the ex parte requests.

There is very much dark cloud lingering over these judges opinions because we don't know what they say, but we know they have expanded the ability of the government to do dirty things.

Have you ever had something explained to you that on the face sounds like a good idea and then in application it doesn't live up to your expectations? When that happens do you just shrug and keep on the same path or do you try and recalibrate?

How many Democrats were supporting gay marriage in 2000? People change their minds on stuff all the time and often it is based on whose ox is being gored or political expediency. Welcome to life.

You are comparing a personal issue to something that had been routinely complained of as (1) being potentially unconstitutional (Article III appointments); (2) subject to mass abuses; (3) shrouded in secrecy; and (4) very much a process that has now been nothing more than a 4th amendment problem.

This isn't about you figuring out you liking broccoli--this is rebellion against by the republicans because Trump told people to get mad about it....

Nobody woke up and found God, that is for sure.

It wasn't when they spied on Trump. All this is, is a license to get away with whatever they want. The IRS has already been caught through AI monitoring any checking account they see fit.

I'm not making an argument for or against. It's a difficult issue balancing privacy and national security... Always has been.

Really, I'm glad you think you are an expert. And of course you wouldn't be against it, you like government over reach. You like the fact that they waeponized the media against American citizens as Taibbi, Uri, sage Steele and others have come out with. You think 702 is just for foreign intelligence and that's where it ends yet that includes any correspondence with anyone from the US communicating with someone from a foreign country from inside or outside the US giving them a loophole to do so without a warrant. Just part of the big picture. 1st, 2nd, and 4th are amendment under attack and of course political opponents are treated so well. What a joke this has become. Do you need it spelled out? You obviously do? If you can't see it by now get help. When 3 letter agencies are censoring social media, spying on private citizens bank accounts, spying on whatever they wish, meanwhile blue cities look like 3rd world countries that are unsafe. It's just a little obvious, but you and twenty02 keep defending it Homey. Keep voting blue it's obviously the way to go that must be why more and more each day I see OOS plates from blue states roaring to Indiana.

Not a Republican or Democrat issue. Both sets of jerks are two sides of the exact same coin . They view the laws and constitution as mere inconveniences to their pet power plays.

Then when shit goes south, as it has since a good balance of law and freedom (meaning strongly favoring freedom for U.S. citizens) disappears, they run for the hills, or just pass more laws to fix their usual messed up ones.

Somebody (some university pysch dept) did a study using rats to examine the effects of additional rules and regulations, (this was a couple decades ago, so don't remember how you impose rules on rats...) and their conclusion was the rats became less supportive to each other and more aggressive.

My guess is the lesson applies to people, but our current crop of politicians don't seem to ever consider the costs of less freedom. All we heard from either 'side' is the cost of more freedom. "We can't allow this freedom, because XXXXX may happen!"

Always scared of their own shadows about everything that 'may' possibly occur. If they'd stick to the environment, finance, and defense, and slash the budget for most of the rest of their wrecking crew stuff. The people, especially the poor, and this country, could thrive.

I will freely admit it--I struggle with following Diary of a Madman posts. You've worked yourself up into such a frenzy that you are seeing ghosts, the New World Order and Santa Claus all sitting down to dinner at your local Ponderosa

Read up--the FISA courts as constructed by the republican appointees to the courts and their shadow opinions are a major problem. The appointment of these judges to the FISA Courts by the Chief Justice of the Supreme Court is very much a constitutional question mark as an article III violation.

Have a cup of coffee and pall mall and relax.
 
I just looked it up. Big duesenberg museum along with a bunch of other car museums. We may hold the annual Dream Team victory celebration/reunion there. @hookyIU1990 pull out those NB Griller 2000s and that Indiana jones hat you had on. Got another museum for you to inspect
Drove by some big Labor Day auto auction they have right by the freeway there one year on the way to N Michigan. Looked like a cool scene.
