What's bat-shit crazy is this view that the infallible noble founders literally thought of everything, and that anything they didn't spell out in words, very specifically, has no Constitutional protection at all. Originalism is a stupid philosophy for many reasons, in part because the context of the time in which they were written. The founders didn't envision the Constitution being even relevant to non-whites or to women.
So, yeah, they left a few things out.
