N Y Times: Deflating Deflategate, the evidence & methodology of the Wells report is deeply flawed

The NFL publicly announced that they were going to consult with a group of scientists at at certain major US University regarding the data. (Google is your friend). When nothing from that University showed up in the Wells report, some red flags flew up in LOTS OF PEOPLE'S MINDS, not just mine.
 
Just like he was innocent when he didn't cooperate with the investigators in the first place...

How did he not cooperate? He answered every question and was available for as long as it took. There is nothing in the CBA about giving up the right to privacy.

So what if they ask for the phone info and you comply. What's next? They'll ask for your computers. You say "no way." They then say"not cooperating!"

The witch hunt doesn't ever end. You do not give up you rights to advance the witch hunt to the next level. The NFLPA would have told Brady to go eff himself, that he was on his own, if he shared phone data. Union workers/ union leaders do not share such info with management unless it is in the CBA. They asked him to voluntarily choose which phone records were relevant. They didn't want access to his phone. It's impossible to get more reasonable than that. Saying he "didn't cooperate" is perfectly accurate.
 
The CBA does not say that union members are required to share personal phone records of any kind with management. . Saying he "didn't cooperate" is utterly full of shit.

If your boss asks you to give him a list of phone calls you have made from your personal cell phone in the last year, do you say "sure boss!" no. freakin'. way.

The Rog isn't Brady's boss, and the NFL isn't his employer, dumbass. And the CBA gives the Rog very wide (almost unlimited) latitude when it comes to this kind of thing. That's the NFLPA's fault. They've always been a weak-ass union.

The CBA specifies that you cooperate with investigations. It does not give one side the right to unilaterally define what it means to be cooperative..

The NFL isn't management, DUMBASS. The Commish's Office (which is really what we're talking about here) is an office that has been empowered by the league members, and by the players union through the CBA, to handle disciplinary matters.

I'm not even sure exactly what Brady's legal theory will be. Defamation like Vilma? Since the Rog decided his appeal instead of an arbitrator, he can't follow Peterson's coattails.

Settle down. You're not being responsive to what I said. It's not enough to proclaim generic violations like "Managemet trampled all over my rights!" That's not a valid legal claim. You have to prove that management violated either a specific requirement of a statute or a specific provision of a CBA. This is a moe difficult case, because, as I have already reminded you, the NFL is not Brady's employer. The CBA gives the Rog pretty much unlimited discretion on discipline cases, so it's hard to see what specific right of Brady's was violated.

A legal theory, which is necessary for any case, is the application of facts to a specific law. Your argument is just "Wahhh! Tom was treated unfairly!"

Again, that's not a LEGAL theory. It's simply an interpretation of the CBA. And the Favre thing is irrelevant. That was under the previous CBA.

It's not enough for Brady to prove that the NFL treated him unfairly. He also has to explain why that unfair treatment is illegal. That's the "legal theory" part you are skipping over.

It's a good thing you're not a lawyer.

Let me tell you a non-Brady story to explain this. I once fired an employee for theft. He filed for unemployment. In his application, it wasn't enough for him to just claim that we fired him for no reason. He had to cite the specific statutes and regulations that afforded him relief through unemployment compensation (of course, he didn't do this himself, the folks at JFS are more than happy to help people with this part of it). As a response (and, of course, without help from anyone), I was required to show evidence of the actions he was fired for, demonstrate why they were violations of our employment policy, and cite specific statutes and regulations which justified the termination under Ohio law.

For Brady to win in court, he'll have to prove:

1. The NFL treated him unfairly. (This probably won't be that hard.)
2. Said unfair treatment was a violation of the CBA. (This will be harder, because the NFLPA sucks, but he has the right lawyer to do it.)
3. Federal Court is the appropriate forum for addressing his complaint. (This is easy; he's appealing an arbitration decision.)
4. The Court is justified in granting relief. (This will be the most difficult, because the CBA makes it clear that discipline is at the discretion of the Commish; in that case, it won't be enough to prove that the Rog was wrong, or even unfair; he'll need to convince the court that the Rog was arbitrary and capricious, which is a near-impossible task.)*

A good legal theory combines the facts (1&2 above) with the law (3&4) in order to get relief. It's simply not enough to prove that someone wronged you. You have to also demonstrate how the law offers judicial relief for said wrong.

Let me offer a simple, colorful example. If I were to walk up to you in person and accuse you of something horrible, say, raping kittens, that would be wrong. I would have aggrieved you. But you'd have no legal recourse to do anything about it. If, however, I took out a full-page ad in your local paper claiming you raped kittens, the law would give you recourse to sue me (and the paper).

* Here's a freebie: Brady's legal team should argue to the court that the disciplinary process under the CBA is inherently arbitrary and capricious so long as the Rog himself hears appeals. If the court agrees, the judge will either then hear evidence and rule on the matter de novo (without giving any deference to the Rog's decision), or vacate the Rog's order and send the matter to an independent arbitrator.

You understand how expert testimony is used, but the decision to file, and the legal theory under which a claim is made, they are wholly different animals. That's why Brady's lawsuit will spend very little time on what's wrong with the Wells report's findings, and most time on what's wrong with the process.
