You're like Tom Brady's own personal little Batman, aren't you?
The NFL publicly announced that they were going to consult with a group of scientists at at certain major US University regarding the data. (Google is your friend). When nothing from that University showed up in the Wells report, some red flags flew up in LOTS OF PEOPLE'S MINDS, not just mine.

Just like he was innocent when he didn't cooperate with the investigators in the first place...
How did he not cooperate? He answered every question and was available for as long as it took. There is nothing in the CBA about giving up the right to privacy.

So what if they ask for the phone info and you comply. What's next? They'll ask for your computers. You say "no way." They then say"not cooperating!"

You say :"OK, here's my computers". What's next? They'll ask for your bank statements. You say "no way." They then say"not cooperating!"

The witch hunt doesn't ever end. You do not give up you rights to advance the witch hunt to the next level. The NFLPA would have told Brady to go eff himself, that he was on his own, if he shared phone data. Union workers/ union leaders do not share such info with management unless it is in the CBA. It isn't.

They asked him to voluntarily choose which phone records were relevant. They didn't want access to his phone. It's impossible to get more reasonable than that. Saying he "didn't cooperate" is perfectly accurate.

The CBA does not say that union members are required to share personal phone records of any kind with management. . Saying he "didn't cooperate" is utterly full of shit.

If your boss asks you to give him a list of phone calls you have made from your personal cell phone in the last year, do you say "sure boss!" no. freakin'. way.

The Rog isn't Brady's boss, and the NFL isn't his employer, dumbass. And the CBA gives the Rog very wide (almost unlimited) latitude when it comes to this kind of thing. That's the NFLPA's fault. They've always been a weak-ass union.

Brady is a member of a LABOR UNION, you stupid dumbass.

If you are a union leader, do you give management your phone records "because they say so"?

The CBA specifies that you cooperate with investigations. It does not give one side the right to unilaterally define what it means to be cooperative..

Brady is a member of a LABOR UNION, you stupid dumbass.

If you are a union leader, do you give management your phone records "because they say so"?

The CBA specifies that you cooperate with investigations. It does not give one side the right to unilaterally define what it means to be cooperative..

The NFL isn't management, DUMBASS. The Commish's Office (which is really what we're talking about here) is an office that has been empowered by the league members, and by the players union through the CBA, to handle disciplinary matters.

I'm not even sure exactly what Brady's legal theory will be. Defamation like Vilma? Since the Rog decided his appeal instead of an arbitrator, he can't follow Peterson's coattails.

I did read that his lawyers are thinking about filing in Minnesota. That could be a sign that they will try to follow some sort of labor law theory, since Minnesota is probably the only state such a theory would fly in.

"It does not give one side the right to unilaterally define what it means to be cooperative."

In cases of behavior "detrimental to the league," yes, it pretty much does.

Talking the Talk.

Feeble final attempt to bully the rog and influence the decision.

He's always displayed anxiety and hostility when not in control.

Reeks of fear.

Well, if you read what I linked earlier, and followed its internal links, instead of just insisting that it wasn't news, you would know the 5 facets of his legal case, YOU STUPID DUMBASS.

the NFLPA believes it has a strong argument, already being prepared, based primarily on five points, which an NLFPA source laid out.

• The NFL policy for handling equipment in the NFL is in the club manual and pertains to club personnel, not players. The NFLPA would argue that the NFL suspended Brady four games under a policy that doesn’t apply to him.

• The Wells Report, the investigation on which the NFL based its suspension, alleged Brady was “at least generally aware” that footballs had been tampered. The NFLPA would argue that the “general awareness” standard has no legal merit – either Wells found direct evidence, or he didn’t.

• The NFLPA would argue Brady – given the rules in the club manual did apply to him – received a punishment without precedence. Under the collective bargaining agreement, players have a right to know specific punishment for specific violations.

• The NFLPA plans to cite a specific example in oral arguments in an effort to prove Brady’s suspension was arbitrary. Last year, the league caught teams tampering with footballs by placing them in a heater, a violation of the club manual. The team, the NFLPA source said, received a letter from the league and no further reprimand.

• The NFLPA would mount an argument against the procedure the Wells Report used to measure the inflation and deflation of footballs, saying there was no previous standard.

Well, if you read what I linked earlier, and followed its internal links, instead of just insisting that it wasn't news, you would know the 5 facets of his legal case, YOU STUPID DUMBASS.

---

the NFLPA believes it has a strong argument, already being prepared, based primarily on five points, which an NLFPA source laid out.

None of that is an actual legal theory. It's just a collection of strategy and talking points for disparaging the Rog's decision. Ask your buddy Florio about the difference.

Federal courts do not care whether footballs were deflated or not. It is irrelevant to the violating of any law.

They do care a lot about whether a union worker's rights were trampled by management by a failure to comply with procedures and protocols that were specified in a collective bargaining agreement.

That is relevant to violations of labor law.

Sigh...

Settle down. You're not being responsive to what I said. It's not enough to proclaim generic violations like "Managemet trampled all over my rights!" That's not a valid legal claim. You have to prove that management violated either a specific requirement of a statute or a specific provision of a CBA. This is a moe difficult case, because, as I have already reminded you, the NFL is not Brady's employer. The CBA gives the Rog pretty much unlimited discretion on discipline cases, so it's hard to see what specific right of Brady's was violated.

A legal theory, which is necessary for any case, is the application of facts to a specific law. Your argument is just "Wahhh! Tom was treated unfairly!"

No, the argument is 5 very specific ways in which Brady's treatment was inconsistent with the rules of the NFL, with procedures spelled out in the collective bargaining agreement, and with precedent of how the same alleged violations were punished before.

If teams were warming up footballs with a space heater and the NFL said "hey there, stop it right now!" and

if a team (the Colts) was caught with needles taped in their sleeves to deflate footballs for Peyton Manning in a visit to Jacksonville, and the NFL said "hey there, stop it right now!" and

If Brett Favre is asked to turn over his cell phone as part of an investigation into sending pics of his dick to women, and he refuses to comply, and you do NOT suspend him for that noncompliance,

you cannot abandon such precedents just because, as the card-carrying leader of the New York Football League, you and your 12 vice presidents who also used to work for the New York Jets have a problem with the success of your main rival.

Again, that's not a LEGAL theory. It's simply an interpretation of the CBA. And the Favre thing is irrelevant. That was under the previous CBA.

It's not enough for Brady to prove that the NFL treated him unfairly. He also has to explain why that unfair treatment is illegal. That's the "legal theory" part you are skipping over.

All five points speak to ILLEGAL acts by the czar of the NFL, an man whom is employed at the whim of 32 owners, who comprise management, which the union is opposing. No court cares a bit about unfairness. I am not skipping over anything..

It's a good thing you're not a lawyer.

Let me tell you a non-Brady story to explain this. I once fired an employee for theft. He filed for unemployment. In his application, it wasn't enough for him to just claim that we fired him for no reason. He had to cite the specific statutes and regulations that afforded him relief through unemployment compensation (of course, he didn't do this himself, the folks at JFS are more than happy to help people with this part of it). As a response (and, of course, without help from anyone), I was required to show evidence of the actions he was fired for, demonstrate why they were violations of our employment policy, and cite specific statutes and regulations which justified the termination under Ohio law.

For Brady to win in court, he'll have to prove:

1. The NFL treated him unfairly. (This probably won't be that hard.)
2. Said unfair treatment was a violation of the CBA. (This will be harder, because the NFLPA sucks, but he has the right lawyer to do it.)
3. Federal Court is the appropriate forum for addressing his complaint. (This is easy; he's appealing an arbitration decision.)
4. The Court is justified in granting relief. (This will be the most difficult, because the CBA makes it clear that discipline is at the discretion of the Commish; in that case, it won't be enough to prove that the Rog was wrong, or even unfair; he'll need to convince the court that the Rog was arbitrary and capricious, which is a near-impossible task.)*

A good legal theory combines the facts (1&2 above) with the law (3&4) in order to get relief. It's simply not enough to prove that someone wronged you. You have to also demonstrate how the law offers judicial relief for said wrong.

Let me offer a simple, colorful example. If I were to walk up to you in person and accuse you of something horrible, say, raping kittens, that would be wrong. I would have aggrieved you. But you'd have no legal recourse to do anything about it. If, however, I took out a full-page ad in your local paper claiming you raped kittens, the law would give you recourse to sue me (and the paper).

* Here's a freebie: Brady's legal team should argue to the court that the disciplinary process under the CBA is inherently arbitrary and capricious so long as the Rog himself hears appeals. If the court agrees, the judge will either then hear evidence and rule on the matter de novo (without giving any deference to the Rog's decision), or vacate the Rog's order and send the matter to an independent arbitrator.

Damn....chitter is a scientist and a lawyer?

Maybe he should take his arguments to the cooler...there he could argue with other people that think they know what they're talking about.

You understand how expert testimony is used, but the decision to file, and the legal theory under which a claim is made, they are wholly different animals. That's why Brady's lawsuit will spend very little time on what's wrong with the Wells report's findings, and most time on what's wrong with the process.

"We suspended him for four games despite lacking any actual evidence that he did something. We've now seen the error of our ways and understand that there's no credible reason to believe he did anything wrong. We're therefore reducing his suspension to 2 games, because a two game suspension for literally no reason makes sense. Reasonable people should totally be on board with that".

What, all that wouldn't fit on the MemeMaker app that you've fallen in love with?

You seriously need to come in off the ledge.

Or jump.

I don't care either way.

But you can't continue on like this - its killing me.

Talking the Talk.

Feeble final attempt to bully the rog and influence the decision.

He's always displayed anxiety and hostility when not in control.

Reeks of fear.

What we’re looking at, in the absence of red-handed guilt, is the NFL, its investigatory arm, and that arm’s hired experts railroading an investigation with shoddy, biased works of bad science, and then holding up their homework to Roger Goodell, who sticks a gold star on it and calls it “highly credible.” It’s a work. And as long as the NFL continues to pretend that its commissioner issues judicious opinions from his seat at the head of the court, league cronies will be forced to gin up enough evidence-like substances to work the courts.

And you still don't seem to be aware that people are just screwing with you.

Even the Brady-hating IDIOT Stephen A Smith has now completely back tracked on his "Brady is guilty" position today, a complete 180.

He even admits that the reason Brady probably didn't give up his phone is so the contents wouldn't be made public like his emails ended up public.

The Best part? He finally admits that ."It appears the NFL were after BB and the Patriots" and that "They should Let Brady play"

there is hope for the other idiots out there (and on here)

For someone that "claims" to be so smart, you are just flat dumb to media spin. Of course they are saying he's not guilty. This is all spin, done by Brady's team to "vilify" the league and for the talking heads to drive up ratings. This happens all the time with high profile stuff. The talking heads keep spinning and going back and forth like a ping pong ball. For someone that claims you've been a scientific expert (I'll bet all 4 cases were hopelessly lost after your testimony), you are simply clueless on so much. You need to get out of the lab more and check in with reality. While I don't feel sorry for you, I do feel sorry for anyone who actually knows you are works with you, because your Napoleon syndrome must alienate you pretty badly.

Super. But why do you care so much? Is this your entire life? Look at all your posts in this thread. You do all of this asinine "research" and people just post pus gifs in response. No one cares. We're just watching the tire fire.
